Designer’s Disclosure

Elizabeth Sosa Boutique Creative Company (the “Company”) is committed to maintaining mutual agreement of services for its users. Our Designer’s Disclosure (“Designer’s Disclosure”) is designed to help you understand how our services work and what you can aspect from us and what we provide to you and what we aspect from you and to assist you in making informed decisions when using our Product and Service.

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at https://elizabethsosa.com. “Product” and “Service” refers to the Company’s products and services accessed via the Site, the terms “designer” “I,” “my,” “we,” “us,” and “our” refer to the Company. “You” and “Client” refers to you as a user of our Site or our Product and Service.

By accessing our Site or our Product and Service, you accept our Designer’s Disclosure, Privacy Policy and Terms of Use found here: https://elizabethsosa.com, and you consent to our services and by purchasing products from this site you understand what you are purchasing and your signature constitutes your agreement to follow and be bound by the designer’s terms and conditions, usage and copyright. For this reason, I encourage you to read these terms and conditions carefully before acceptance of services and terms as described in the proposal and this Designer’s Disclosure.

I. OVERVIEW OF PROJECT

Elizabeth Sosa Boutique Creative Company will provide our clients with creative design services as per the terms and conditions detailed in this designer’s disclosure and the proposal in a professional and timely manner. The proposal will include overview of the project, deliverables, revisions, start date, project deadline, cost, payment terms, copyright and usage and acceptance of terms.

As your designer, I will do my best to meet your project goals with clarity, structure and attention to detail so that you are completely satisfied and happy with my creative design services.
Nevertheless, it’s always best practice to have a few simple guidelines and expectations in writing in order to avoid any confusion or misunderstanding along the way while developing designer /client relationships.

You agree to provide the designer any information needed in order to complete the project. You agree to carefully review and approve the designs in a timely manner. You agree not to request any additional work at designers expense, it is considered beyond the “Scope of Work”. You agree to pay the agreed upon amount on the scheduled due date.

II. DELIVERABLES

An initial consultation and feedback session is coordinated with the client, at the meeting the client and designer will discuss the project details, timeline and schedule a completion date. This meeting can take place by phone, email, in-person or video conference. The client will be asked an in-depth series of questions that will help define the direction and give the designer a better understanding of the project requirements and will help the client articulate their expectations.

What creative design service will you receive?
Depending on the service you choose or the project at hand, you may receive UX website design, logo and brand guidelines, website development, graphic designs, or illustrations.

How will you receive your original vector files?
You will receive any of the following vector formats depending on the project at hand: 100% editable and scalable (SVG) vector file with individual layers, easy to change color and composition, High quality, 300 DPI, CMYK Ready for print (PNG) vector file (RGB) Ready for web vector file, (PDF) vector file.

When will you receive your digital vector files?
You will receive an order summary of the products you’ve purchased from the site and how to instantly download your design(s). For custom orders the designer will personalize your design(s) and delivery methods will be by email or share your digital files via Google drive or clients preferred method. I recommend that you safely store your files away. I will not provide source access that I used in making your files for you to edit.

III. APPROVAL AND REVISIONS

The designer will seek clients approval and sign-off before each phase of the project milestones. Limit 3 designs and 3 rounds of revisions. Any changes to the artwork after it has been approved by the client will be subject to additional charges at the designers standard hourly rates.

If the client requires more than the amount of allocated revisions or starts adding to task revisions and /or requests additional assets, it is considered beyond the “Scope of Work” and the designer will bill the client for the additional hours at the designer’s standard hourly rates.

I encourage clients to be very clear about what they would like from the beginning at our initial meeting. It’s important to keep notes and to make a plan of what you would like to accomplish before the design process begins and always put all requests in writing.

Additional charges may apply depending on the level of website development required for any “out-of-the-box” functionality and custom coding work at senior developer standard hourly rates.

Hourly rates for creative design services listed on this site are subject to change without notice at the designers discretion.

IV. COPYRIGHT AND TERMS OF USE

DEFINITION:

PERSONAL USAGE LICENSE – Limited personal use of the artwork for personal purposes. Ownership remains that of the designer of the artwork and may continue to use it for their own purposes and license it to others.

COMMERCIAL USAGE LICENSE –  Limited commercial use of the artwork for commercial purposes. Ownership remains that of the designer of the artwork and may continue to use it for their own purposes or license it to others.

EXTENDED COMMERCIAL USAGE LICENSE – Limited extended commercial use of of any original artwork for a commercial purposes for a specific project for a limited time period. Ownership remains that of the designer of the artwork and may continue to use it for their own purposes but, cannot license it to anyone else for the duration of the agreement.

PERSONAL, COMMERCIAL, EXTENDED COMMERCIAL USAGE LICENSE ONLY and for limited use of any original artwork, graphic designs, illustrations, ux designs, copy, layout, composition created by the designer. Ownership and copyright is exclusively that of the designer Elizabeth Sosa. You may not modify or trace the artwork or use it in another medium. You may NOT copy, print, share, sell, resale, use on print-on-demand sites, free instant download sites, use on products you plan to sell and NOT intended for unauthorized distribution or reproduction of files to anyone in any form without written permission by Elizabeth Sosa and purchasing additional usage rights.

Any original artwork or graphic representations: graphic designs, illustrations, ux designs, copy, layout, composition on this site were created from scratch by the designer, Elizabeth Sosa are subject to copyright. Any photography or mockups used by the designer to acquire feedback from users and are intended for mockup purposes only and any typography used in designs are subject to copyright and used with permission by their respective owners.

You give the designer permission to use any information provided by you to include in your project and that you guarantee that these assets are owned by you or given permission to you to be used in such a context.

When I receive your payment in full, copyright is automatically transferred to you. You will own the graphics that were custom made for you however, if it’s not a custom design created specifically for you or your company and without written permission by Elizabeth Sosa and purchasing additional usage license the ownership of all copyrights and the original artwork shall be retained by Elizabeth Sosa.

You agree to give permission to the designer to use and showcase the project on Elizabeth Sosa Boutique Creative Company’s portfolio and on this site https://elizabethsosa.com.

V. PAYMENT TERMS

A 50% deposit is due upon acceptance of services and terms of proposal, the remaining balance is due upon completion of the work. Retainer payment is due in full in the agreed upon amount at the beginning of each month or year before design services are rendered. 10% off discount available on yearly plans. Project-based contract hours to be paid in the agreed upon amount on their scheduled due dates. Payment plans available, an initial deposit is required and the remaining balance paid in 4 easy payment installments. Handmade products are to be paid in full before shipping.

I offer my clients 3 simple solutions based on their individual business needs which include; Project-based hourly rates, fixed-fee pricing and retainer packages.

I accept the following payment methods: Business and Personal Checks, Visa, MasterCard, Discover, American Express, ACH Transfers, Cash.

If payment is not received the client’s project comes to a halt and order is canceled for non-payment.

VI. CANCELLATION AND RETURN POLICY

I do not accept returns, exchanges or cancellations on any artwork, custom graphic design, digital downloads, handmade or personalized products or services purchased directly from this site or any products and services listed on third-party sites.

I do not offer refunds on any products and services. All products and services are custom and made to order, so please review the proofs before signing off and read the product description carefully before placing your order as we cannot cancel custom orders after they go into production or accept returns if the item does not fit, wrong color was selected or if it’s spelled incorrectly.

What to look for when reviewing artwork proofs?
Company information, personal data, spelling, customization, artwork, images and layout.

What to look for when reviewing handmade product descriptions?
Size, color, quantity, fit, size chart, personalization and spelling.

However, in the event of cancellation of custom project agreements, you must send the designer a written notice of cancellation. Ownership of all copyrights and the original artwork shall be retained by the designer and a cancellation fee for work completed and any expenses incurred to-date, shall be paid by the client.

VIII. CHANGES TO DESIGNER’S DISCLOSURE

The company reserves the right to change this disclosure and our Terms of Service at any time without notice. We will notify you of significant changes to our Designer’s Disclosure by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the site and this disclosure page for updates.
